General terms and conditions of the Off-Ride contract

1. Reservations

By booking a multi-day excursion or a day excursion the participant accepts all these contractual conditions. The booking is subject to the relevant payment of the deposit with consequent definition of the contract following written confirmation by Off-Ride 360 (hereinafter called the organiser ) of acceptance of the booking.

2. Reservations and payments

  • Multi-day excursions: the participant is required to pay the deposit (equal to 33% of the total participation fee) via bank transfer within 7 working days of confirmation of booking by the organizer. The day on which the amount is credited by the bank is valid. Without payment of the due amount of the deposit, the organizer reserves the right to not consider the booking valid. The balance of the entire participation fee must be paid by bank transfer 3 working days before the start of the excursion. Before the balance has been paid, the participant is not entitled to receive any service from the organizer. In case of bookings accepted by the organizer in the 6 working days before the start of the excursion, the participant will not have to pay any deposit, but rather the entire participation fee.
  • Same day excursions: the entire participation fee must be paid by bank transfer to the organizer three days before the start of the excursion. The day on which the amount is credited by the bank is valid.
Any reductions for large groups (e.g. schools) can only be agreed upon before confirming the booking and must never be requested at the time of payment. If the participant does not show up at the appointed time, on the day and in the meeting place indicated by the organizer, the deposit and any amount already paid will be retained. Any other expenses agreed during the booking and anticipated by the organizer must be recognized and reimbursed to the same.

3. Participation fee and expenses

The participation FEE and all costs are indicated in euros and only payments in euros are accepted. The participation fee includes the cost of the hiking guide and the organization of the excursion. The item “other indicative expenses” is the sum to be spent on site quantified according to the expense estimated by the organizer for dinners, overnight stays and breakfasts, plus any on-site transport costs to be paid by the participants. The estimate is indicative (although quite precise) and differences cannot be ruled out. The costs relating to packed lunches are not included in the “other indicative costs” as they may vary based on the needs of individual participants. The amount for “other indicative expenses” must never be sent to the organizer.

4. Changes

The excursions proposed on the website www.off-ride.com and in all Off-Ride 360 social media are subject to change at any time at the discretion of the organizer. If the modifications substantially alter the contract before departure, resulting in an increase in the participation fee exceeding 10% or cancellation by the organizer, for reasons other than force majeure (Art.5), the participant will have the right to withdraw from the contract without any cost only after communicating it electronically to the organizer. The deposit and any amount already paid will be returned to you within 7 working days of the withdrawal request.
In addition to what has just been indicated, the participant will not be entitled to any other reimbursement or compensation. The organizer reserves the right to cancel the excursion when the minimum number of participants has not been reached and provided that this is brought to the attention of the participants in writing (mail) at least 7 days before the expected start date of the multi-day excursion; or at least 2 days before the scheduled start date of the same day excursion. The deposit and any amount already paid by the participant will be returned within 7 working days from the time of cancellation. All changes that the organizer decides to make to the river trek/jeep tour/excursion due to causes of force majeure are excluded from this article (Art. 5).

5. Causes of force majeure

An excursion may be canceled or modified at any time due to causes of force majeure, such as exceptional weather events, hydrogeological or environmental risks (etc.) or in all circumstances that the organizer cannot reasonably predict or resolve. No refund of the amount already paid to the organizer can be claimed in this case. The decision regarding the feasibility or otherwise of an itinerary lies solely with the organizer who is required to carry out the activity with prudence, diligence and skill. The organizer, if possible, will propose an alternative. In the event that the participant does not wish to accept the alternative, he or she will have the right to take advantage of another excursion proposal of an equivalent amount, without additional price, within the following year. If the occurrence of force majeure occurs during the excursion, the established route may be modified, lengthened or shortened and the organizer will not be required to give the participant any reimbursement for the change.

6. Withdrawal

  • Multi-day excursions: the participant has the right to renounce participating in the booked excursion by communicating this within 8 working days before departure, losing only the deposit, as compensation for the withdrawal. Beyond these deadlines the following sums will be charged: 50% of the participation fee from 7 days to 3 working days before departure 100% of the participation fee after these terms.
  • Same day excursions: any cancellations received after 6pm of the booking and payment deadline will involve payment of the entire fee.

7. Duration

The excursion begins and ends on the day and in the meeting place indicated by the organizer within 24 hours of departure, excluding the times and means of transfer to reach it.

8. Liability and insurance regime

The participant declares that he takes part in the excursion at his own risk and under his own responsibility. The participant will be held responsible for any damage to people or things caused by him voluntarily or involuntarily and must take advantage of adequate insurance coverage before departure. The organizer, its collaborators and partners deny any responsibility for any harmful event caused by the participant. The participant – as well as his relatives or beneficiaries – waive the right to lodge a complaint following the occurrence of this event. Any dispute with third parties must be resolved directly by the participant with the third parties.

9. Equipment

The participant must take care of their personal items as well as auxiliary equipment rented on request. The participant’s equipment may be checked at any time by the organizer. If the participant is found to be in possession of insufficient or inadequate equipment, the organizer could decide to exclude him from the excursion even at the moment of departure. There will be no refunds of expenses already incurred by the participant and the return will be entirely at his expense. Furthermore, the organizer is not responsible for any damage caused by the participant’s unsuitable equipment.

10. State of health

The participant is always held responsible for choosing the itinerary in accordance with his/her state of health and training. In the event of evidently inadequate physical fitness, the organizer reserves the right at any time to exclude him from the excursion without the obligation to refund the amount already paid.

11. Age of participants

Eligible participants are only adults over 18 years of age. Minors can participate only after the written consent of the organizer and only if accompanied by a legal representative.

12. Photographs

All participants authorize the organizer, and its assignees, to use and disseminate the material (audio, video, photographic) created during the excursion without having anything to claim in terms of compensation or rights, unless explicitly stated otherwise. They also declare to be informed that the publication may take place via multimedia (internet, radio, television, CD ROM) and/or editorial (advertising material, books, magazines).

13. Classification and difficulty of the itineraries

  • D = Difficult You need to be able to navigate complicated situations. They require good physical preparation and absence of dizziness.
  • M = Medium They require some awareness of your stamina and physical capabilities.
  • F = Easy They do not require specific training other than just the desire to have fun.
